General Terms and Conditions (GTC) and Privacy Policy
Introduction
ONELINE AG, hereinafter referred to as the “Operator”, offers various competitions via its platform win4win.ch, hereinafter referred to as the “Platform”. These competitions are organized in cooperation with a large number of partners, the details of which can be found on the specific competition page on the platform. Participation in these competitions is subject to acceptance of the following General Terms and Conditions, which, together with the Privacy Policy, form the basis of the contractual relationship between the operator and the participants, hereinafter referred to as “Participants”.
Scope and area of application
These Terms and Conditions apply to all promotions, participations and interactions in the context of competitions on win4win.ch. They govern the conditions under which use of the platform and participation in the competitions take place. By registering on the platform and participating in the competitions, the participant expressly agrees to these GTC. The GTC can be viewed at any time on the platform’s website and can be printed out for personal use.
Eligibility and registration process
Eligibility to participate: Only natural persons who are permanently resident in Switzerland and have reached the age of 18 at the time of participation are eligible to participate. All employees of the operator, the participating partner companies and their direct family members and persons living in the same household are excluded from participation. This regulation serves to ensure transparency and fairness in the competition process.
Registration process:
Participation in the competitions requires prior registration on the platform. As part of this registration, various personal data must be provided, the scope and type of which may depend on the respective competition. This generally includes first and last name, e-mail address, telephone number and title. This data must be provided truthfully. By registering, the participant agrees to accept the terms and conditions and the privacy policy.
Double opt-in procedure:
Once registration has been completed, a confirmation email containing a specific link will be sent to the email address provided. Only by clicking on this link is the registration fully completed, whereby the participant gives his/her express consent to participate in the competition and to the processing of his/her personal data in accordance with the data protection declaration. This procedure serves to protect the participants and ensures that the registration is deliberate and intentional.
Advertising consent and communication
Consent to marketing activities:
By participating in a competition as well as the double opt-in confirmation, the participant agrees that the operator and the participating partner companies may use the contact details provided for marketing purposes, such as sending newsletters, text messages or contacting via telephone. This consent includes express agreement to the use of the data for the specified purposes and can be revoked by the participant at any time.
Right of withdrawal and unsubscribing:
Every participant has the right to withdraw their consent to the use of their data for marketing purposes at any time. A revocation can be made simply by using the unsubscribe options provided in each marketing material, such as an unsubscribe link in the newsletter, or by sending a direct message to the operator via the email address management@win4win.ch. After receipt of the revocation, the participant’s data will no longer be used for marketing purposes and the participant will not receive any further marketing communications from the operator or the partners involved.
Determination of winnings, notification and awarding of prizes
Drawing procedure:
The winners of the competitions are determined after the end of the competition phase by means of a random, computerized procedure from all eligible and registered participants. The exact criteria and conditions for determining the winners are defined specifically for each competition and are clearly communicated in advance.
Notification of winners:
Winners will not be notified directly. The prizes will be delivered automatically according to the data provided. Physical prizes will be sent by post to the address provided, while digital prizes will be sent by email. A separate notification will only be sent in exceptional cases, such as special delivery requirements or deviating delivery modalities.
Transfer and payment of prizes:
The prizes drawn will be made available to the winners directly by the operator or the partners involved. Cash payment of prizes is generally excluded, unless otherwise stated in the specific competition. Physical prizes will be delivered to the address provided by the winner during registration. Any taxes or duties incurred on the prizes are to be borne by the winners themselves.
Privacy policy and protection of personal data
The operator undertakes to comprehensively protect the privacy and personal data of participants. The collection, processing and use of personal data is carried out exclusively within the framework of the statutory provisions of the Swiss Data Protection Act and the European General Data Protection Regulation (GDPR), where applicable.
Purpose of data collection: The personal data provided by the participant as part of the registration and participation in the competitions will be used by the operator exclusively for the implementation and processing of the competitions, communication with the participants, the determination and notification of prizes and for the marketing activities described in the advertising consent.
Specific consent and data processing:
By registering and participating in the competitions, the participant gives his/her specific consent to the processing of his/her personal data for the stated purposes. This consent includes, in particular, consent to the use of contact data for the sending of marketing materials by the operator and the participating partners. The participant has the right to withdraw this consent at any time, whereupon the data in question will no longer be used for the relevant purposes.
Disclosure of data to third parties:
Personal data will only be passed on to third parties as part of the necessary processing of the competitions, the awarding of prizes and the implementation of marketing activities. All third party recipients are obliged to comply with the data protection regulations and to use the data only for the agreed purposes. The operator ensures that only trustworthy partners have access to the data and that data processing is carried out in compliance with the highest security standards.
Data storage, security and rights of data subjects:
The operator will only store participants’ personal data for as long as is necessary for the purposes of running the competition, processing the awarding of prizes and implementing marketing activities, but for a maximum of five years. All technical and organizational measures are taken to ensure a high level of data security and to protect the data from unauthorized access, loss or misuse. Participants have the right to information about the personal data stored about them, to rectification of incorrect data, to erasure of their data and to restriction of processing and to data portability at any time. Inquiries regarding the rights of data subjects can be addressed directly to the operator.
Severability clause
Should individual provisions of these GTC or the privacy policy be or become invalid in whole or in part, this shall not affect the validity of the remaining provisions. The invalid or missing provisions shall be replaced by the respective statutory provisions. Both parties undertake to replace an invalid provision with a valid provision that comes as close as possible to the economic objective and purpose of the original provision.
Applicable law and place of jurisdiction
These GTC and participation in the competitions are governed exclusively by the law of the Swiss Confederation. The place of jurisdiction for all disputes arising from or in connection with the GTC is Zug/ZG, unless mandatory statutory provisions provide otherwise.
